TERMS & CONDITIONSBy hiring any trailer from FSF Hire, the Hirer agrees to the following legally binding terms:
1. Agreement & Acceptance
By paying a deposit, making a booking, or taking possession of any trailer, the Hirer is deemed to have read, understood, and fully accepted these Terms & Conditions.
No verbal agreements or representations override these Terms unless confirmed in writing by FSF Hire.
2. Licence & Eligibility
The Hirer warrants that:
They hold a current, valid, and unrestricted Australian driver licence
They are legally permitted to tow the hired trailer in NSW
They are competent and experienced in towing heavy loads
FSF Hire accepts no responsibility for the Hirer’s driving ability or legal compliance.
3. Hire Period & Late Returns
Hire begins at the agreed pickup time and ends at agreed return time
Late returns will be charged at 2x the daily rate per day or part thereof
FSF Hire reserves the right to recover the trailer at any time if overdue, at the Hirer’s full cost
4. Bond & Security
A security bond may be required and is strictly held against damages, cleaning, fuel (if applicable), late return, or breach of terms
The bond is not automatically refundable and may be partially or fully withheld at FSF Hire’s sole discretion
The Hirer agrees that bond deductions are final and not subject to dispute unless required by law
5. Condition of Trailer
The trailer is deemed to be in good working order upon collection unless otherwise stated
It is the Hirer’s responsibility to inspect prior to use
Any damage reported after departure is deemed to have occurred during the hire period
6. Damage, Loss & Liability
The Hirer is fully liable for:
Any and all damage (including accidental damage)
Tyres, wheels, suspension, hydraulic systems, and electrical systems
Third-party property damage or injury
Theft or loss of trailer or components
The Hirer agrees to cover full replacement cost of any damaged or missing items, not depreciated value.
FSF Hire accepts no liability for:
Loss of earnings, business interruption, or consequential damages
Accidents, injuries, or incidents arising from use of the trailer
7. Use Restrictions
The trailer must NOT be:
Overloaded beyond rated capacity (2000kg or 3500kg GVM depending on trailer)
Used off-road unless expressly approved
Used for illegal, unsafe, or negligent purposes
Sublet, re-hired, or transferred to any third party
Any breach results in immediate termination of hire without refund.
8. Vehicle Compatibility
The Hirer is solely responsible for ensuring:
Their tow vehicle is legally rated and mechanically suitable
Proper hitching, coupling, safety chains, and electrical connection
Load distribution and securing of cargo
FSF Hire accepts no liability for towing setup errors.
9. Breakdowns & Incidents
The Hirer must immediately notify FSF Hire of any breakdown or incident
No repairs are to be carried out without written approval
Recovery, towing, or repair costs are the Hirer’s responsibility
10. Termination of Hire
FSF Hire reserves the right to:
Terminate hire immediately without refund if terms are breached
Repossess the trailer without notice if overdue, unsafe, or misused
Charge all associated recovery costs to the Hirer
11. Indemnity
The Hirer indemnifies FSF Hire, its directors, employees, and agents against all claims, damages, losses, or expenses arising from:
Use or misuse of the trailer
Breach of these Terms
Negligence or unlawful conduct
